Daycano is a trade name of K&L Rock Simulations s.r.o., ID No. 300 34 221, Jičínská 226/17, Žižkov, 130 00 Prague 3. All trading takes place in a simulated environment; rewards are paid according to the programme rules.

This List forms part of the Daycano Terms of Service (Terms of Service, Sections 3 and 5) and is referred to in the Risk / Simulated Trading Disclaimer (Section 8), the AML/KYC Policy (Section 6) and the Refund Policy (Section 5(f)). If it conflicts with the Terms of Service, the Terms of Service prevail.

1. Structure#

Restricted jurisdictions are grouped into four tiers according to the reason for the restriction. Tiers 1 and 2 follow from international sanctions and anti-money-laundering standards. Tiers 3 and 4 follow from Daycano's own policy and the requirements of its service providers.

TierBasisNature
Tier 1International sanctions (UN / EU / OFAC)Mandatory exclusion
Tier 2FATF high-risk jurisdictionsMandatory exclusion (call for action) or enhanced due diligence (increased monitoring); reviewed quarterly
Tier 3United States personsPolicy exclusion, also required by our technology and payment providers
Tier 4Operational and payment-risk exclusionsPolicy exclusion based on the requirements of our payment providers

2. Restricted Jurisdictions#

2.1 Tier 1: Sanctions. The Services are not available in connection with the following jurisdictions and territories, which are subject to sanctions regimes of the European Union, the United Nations and/or the U.S. Office of Foreign Assets Control, or which Daycano excludes in order to comply with those regimes:

  • Afghanistan
  • Belarus
  • Central African Republic
  • Cuba
  • Democratic Republic of the Congo
  • Eritrea
  • Guinea-Bissau
  • Iran
  • Iraq

  • the occupied territories of Ukraine: Crimea and the city of Sevastopol, and the Donetsk, Luhansk, Kherson and Zaporizhzhia regions

2.2 Tier 2: FATF high-risk jurisdictions. Jurisdictions on the current FATF list of high-risk jurisdictions subject to a call for action are excluded in the same way as Tier 1. Jurisdictions on the current FATF list of jurisdictions under increased monitoring are not excluded automatically; traders connected to them are subject to enhanced due diligence under the AML/KYC Policy. Daycano reviews both FATF lists every quarter and updates this page after each review.

2.3 Tier 3: United States persons. The Services are not available to United States persons. For the purposes of this List, a "United States person" means:

  • a citizen or national of the United States, regardless of current residence;
  • an individual resident or domiciled in the United States or any of its territories (including Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa and the Northern Mariana Islands);
  • an entity incorporated or organised under the laws of the United States or any state of the United States; or
  • a holder of a U.S. permanent resident card (Green Card) or any other person who is a U.S. tax resident under applicable law.

2.4 Tier 4: Operational and payment-risk exclusions. The Services are not available in connection with the following jurisdictions, which our payment providers do not serve: Bouvet Island, Cook Islands, Papua New Guinea and Vanuatu.

2.5 Jurisdictions not restricted. The Czech Republic, where Daycano is established, and Poland are not restricted jurisdictions. Other member states of the European Union and the European Economic Area are not restricted unless listed above.

3. Rules Applying to Restricted Jurisdictions#

3.1 Who is excluded. Daycano does not offer the Services to, and does not accept registrations from, persons who: (a) are nationals, citizens or residents of; (b) are incorporated or established in, or have their registered office or principal place of business in; or (c) are physically located in, a jurisdiction listed in Section 2 (as excluded). Daycano may determine this on the basis of identity verification data, payment data, IP address and other information available to it. These rules supplement the Terms of Service, Section 5.

3.2 Basis for restriction. A jurisdiction may be listed where access to the Services from it would: (a) be prohibited or restricted by applicable international sanctions; (b) present an elevated risk of money laundering or terrorist financing; (c) be contrary to local law; (d) conflict with the requirements of Daycano's payment, banking or technology providers; or (e) present, in Daycano's reasonable assessment, an unacceptable operational or compliance risk.

3.3 United States persons. The Services are not available to United States persons as defined in Section 2.3.

3.4 Evasion. Using a VPN, proxy service, false declaration or any other method to conceal your true location, residence or nationality in order to access the Services from a restricted jurisdiction is a material breach of the Terms of Service. It leads to suspension or termination of the account under the Terms of Service, Section 12, without a refund of the Programme Fee (Refund Policy, Section 5(f)) and with forfeiture of any unpaid Performance Reward.

3.5 Updates. Daycano may update this List at any time, in particular in response to changes in sanctions regimes, FATF lists or the requirements of its service providers. The current version is always published on this page, with its effective date.

3.6 Jurisdiction added during your participation. If a jurisdiction connected to you becomes restricted while you hold an account, and you have not breached Section 3.4, Daycano will close the account and, to the extent permitted by applicable sanctions law: (a) refund the Programme Fee for any Programme in which no simulated position has yet been opened; and (b) pay any Performance Reward that had already become payable before the restriction took effect, subject to completed identity verification.
